What You Need to Know

On January 9, 2026, the Board of Certification/Accreditation (BOC) regained its status as a CMS‑approved Accrediting Organization (AO) after a federal court granted BOC’s request for a temporary restraining order (TRO) against the Centers for Medicare & Medicaid Services. This ruling reverses CMS’s December 2, 2025 termination of BOC’s AO approval and restores BOC’s authority to operate as an accrediting body “until further notice.” BOC’s reinstatement means that the organization can again provide the full range of accreditation and reaccreditation services recognized by CMS in all states except for California, Florida, New York, and Texas. The restrictions announced in May 2025 remain in effect in these 4 states.  BOC is encouraging suppliers to reach out to their compliance team directly at [email protected] if they have questions, especially if accreditation renewals or new applications were disrupted by CMS’s December 2025 termination.

It is also important to understand that this legal matter impacts accreditation only. BOC's professional certification programs remain fully intact and unaffected. Credentials earned through BOC—including those for orthotic fitters, mastectomy fitters, and DME specialists—are still valid and recognized without any changes resulting from the TRO or CMS’s earlier action.

What This Means for You

For DMEPOS suppliers located in the 46 states where BOC’s accreditation authority has been fully restored, this ruling means that day-to-day accreditation activities can resume as normal. You may continue using BOC for new applications, ongoing compliance work, and reaccreditation cycles. If your business operates in California, Florida, New York, or Texas, current BOC accreditations are valid, but you will still need to seek new accreditation and/or reaccreditation through a different CMS-approved AO. If you are approaching an accreditation renewal, review your renewal timeline now and take proactive steps to prevent compliance gaps. Document any disruptions caused by CMS’s December termination and work with BOC to clarify your accreditation status.
